1. Acceptance of the Terms

By downloading, accessing, or using the MoFood mobile application or related services (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").

If you do not agree, you must not use the Service.

2. Description of the Service

MoFood is a health and wellness mobile application designed to help users track meals, nutritional intake, weight, physical activity, and personal health-related goals.

The Service may include meal logging, activity tracking, gamification features, educational content, and progress visualization.

MoFood does not provide medical, dietary, or professional healthcare advice.

3. Eligibility

You must be at least 16 years old (or the minimum legal age in your jurisdiction) to use the Service.

By using MoFood, you confirm that you meet this requirement.

4. Account Registration and Security

To access certain features, you must create an account using a valid phone number.

You are responsible for:

• maintaining the confidentiality of your login credentials
• all activity that occurs under your account

MoFood is not responsible for unauthorized access resulting from your failure to secure your account.

5. Personal Use Only

The Service is provided for personal, non-commercial use only.

You agree not to:

• resell, sublicense, or commercially exploit the Service
• copy, modify, or create derivative works
• reverse-engineer, decompile, or attempt to extract source code
• circumvent security or access controls

6. Health Disclaimer

MoFood is a tracking and informational tool only.

It does not diagnose, treat, cure, or prevent any disease or medical condition.

You acknowledge that:

• nutritional values and recommendations are estimates
• health outcomes depend on individual factors beyond the app's control
• you should consult a qualified professional before making health or dietary decisions

Use of the Service is at your own risk.

7. Subscriptions and Payments

Certain features may require in-app purchases or a paid subscription.

Prices, billing cycles, and applicable conditions are displayed within the app at the time of purchase.

Payments may be processed through:

• Apple App Store or Google Play Store (where applicable), subject to their terms, or
• MoFood’s in-app subscription checkout using third-party payment providers (e.g., Juice or Blink), subject to their terms.

All payments are:

• non-refundable, except where required by law or by the applicable provider’s policies
• managed by the relevant billing provider (Apple/Google or the third-party payment processor). MoFood does not control those external billing systems.

8. User Data and Privacy

MoFood collects and processes personal data in accordance with its Privacy Policy.

Reasonable technical and organizational measures are used to protect user data.

MoFood does not sell personal data to third parties.

9. Intellectual Property

All content, trademarks, logos, designs, software, and databases associated with MoFood are the exclusive property of MoFood or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the Service strictly in accordance with these Terms.

10. Service Availability

MoFood aims to provide continuous availability but does not guarantee uninterrupted or error-free operation.

MoFood may suspend, modify, or discontinue any part of the Service at any time without prior notice.

11. Termination

MoFood reserves the right to suspend or terminate your access if you:

• violate these Terms
• engage in abusive, fraudulent, or unlawful behavior

You may stop using the Service at any time.

12. Limitation of Liability

To the maximum extent permitted by law:

• MoFood shall not be liable for indirect, incidental, or consequential damages
• MoFood is not responsible for health outcomes, data loss, or service interruptions

Total liability shall not exceed the amount paid by you in the last 12 months, if any.

13. Indemnification

You agree to indemnify and hold harmless MoFood from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Mauritius.

15. Changes to the Terms

MoFood may update these Terms from time to time.

Continued use of the Service after changes constitutes acceptance of the revised Terms.
